Parental Consent for Routine Physical or Mental Health Services
Beginning September 1, 2025, state law (Senate Bill 12) requires Texas public schools to have written parental consent on file before providing most routine physical or mental health services to students. In accordance with this law, Lovelady ISD must give parents written notice of all health-related services offered at their child’s campus and must have parent permission before staff can provide these supports. These services are designed to promote student safety, wellness, and readiness to learn and may be provided by qualified school staff, including nurses, athletic trainers, and school counselors.
This consent does not take the place of an individualized health plan, 504 plan, or other legally required document, and it does not cover formal medical or psychological diagnoses or long-term treatment, which would require separate written permission. A parent always has the right to withhold consent for or decline any health-related service.
Senate Bill 12
On June 20, 2025, the Governor of Texas signed SB 12 into law, requiring public school districts to obtain parental consent before providing any routine physical or health services to students.
This means schools must have consent on file before offering even the most basic support. For instance, a nurse applying a bandage to a scraped knee or a counselor helping a student manage their breathing during emotional distress would first require parental permission.
The consent does not include formal medical or psychological diagnosis, prescription medication administration without proper authorization or ongoing therapy or treatment requiring parental notification under law. These activities would require separate written consent and parental involvement, unless in emergency or legally exempt circumstances.
